Landmark court ruling for mentally ill prisoners<\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>What\u2019s going on?\u00a0<\/strong>Big news coming from Pakistan&#8217;s Supreme Court. It\u00a0<a href=\"https:\/\/news.yahoo.com\/pakistan-commutes-death-sentence-2-085153081.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-akykujl-iluykthdp-i\/&amp;source=gmail&amp;ust=1613271938243000&amp;usg=AFQjCNEU8bvqY8JAMk2msOLDJXkrq6uLWQ\">set aside the death sentences<\/a>\u00a0of two mentally ill prisoners who have spent\u00a0several years\u00a0on death row. The court said it&#8217;s not okay to impose a death penalty on prisoners who have a serious mental illness, especially if they aren&#8217;t able to understand the reason behind their punishment. The verdict also includes clauses on improving mental healthcare in prisons, and providing mental health awareness\/ sensitivity training to\u00a0prison and police authorities.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>The details:\u00a0<\/strong>One of the two prisoners, Kanizan Bibi, has spent 30 years on death row. In 1989 at the age of 16, Bibi was arrested and sentenced to death two years later in a murder case,\u00a0a charge she denied.\u00a0In 2000, Bibi\u00a0was diagnosed with schizophrenia.\u00a0In 2001, the second prisoner, Imdad Ali,\u00a0was convicted of murdering a religious scholar. In 2008, Ali was diagnosed with schizophrenia. He has spent 18 years on death row and is at least 55 years old.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Tell me more:\u00a0<\/strong>The Supreme Court ordered prison officials to file a presidential pardon petition for Ghulam Abbas, specifically mentioning\u00a0his\u00a0mental health condition. Abbas is another prisoner who\u00a0has\u00a0schizophrenia. In 2006, he was convicted for\u00a0murdering his neighbor, and\u00a0has spent around 15 years on death row.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Looking ahead:\u00a0<\/strong>Bibi&#8217;s and Ali&#8217;s death sentences were reduced to life imprisonment.\u00a0Unlike Bibi and Ali, the Supreme Court didn&#8217;t reduce\u00a0Abbas&#8217; death sentence to life imprisonment. However, all three prisoners will\u00a0be moved to a govt-run mental health facility.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>The context:<\/strong>\u00a0At least 33 crimes carry the death penalty in Pakistan, such as murder and gang rape. In 2019, Pakistan&#8217;s courts handed down\u00a0<a href=\"https:\/\/www.aljazeera.com\/news\/2021\/2\/11\/pakistani-apex-court-bans-execution-of-mentally-ill-patients#:~:text=Imdad%20Ali%2C%2057%2C%20spent%2018,been%20diagnosed%20with%20paranoid%20schizophrenia.&amp;text=The%20verdict%20has%20commuted%20his,the%20sentence%20to%20life%20imprisonment.\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-akykujl-iluykthdp-d\/&amp;source=gmail&amp;ust=1613271938243000&amp;usg=AFQjCNENO7qYbD44msGQq2IRhoeRZv4JNA\">more than 632 death sentences<\/a>, which amounts to 27.3% of all death sentences around\u00a0the world. Even though\u00a0<a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/02\/pakistan-supreme-court-judgement-bans-executions-of-prisoners-with-mental-disabilities\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-akykujl-iluykthdp-h\/&amp;source=gmail&amp;ust=1613271938243000&amp;usg=AFQjCNEW6HZ-vCOxC18OB1wxeHJ5KB3T4w\">Amnesty<\/a>\u00a0welcomed the Supreme Court&#8217;s latest verdict, it&#8217;s\u00a0still urging Pakistan to get rid of the death penalty.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>The bottom line:\u00a0<\/strong>This was reportedly\u00a0a landmark decision by the Supreme Court when it comes to dealing with mentally ill prisoners. A death sentence won&#8217;t automatically be ruled out for prisoners with mental health issues. However, if a death row prisoner\u00a0who has\u00a0a mental illness\u00a0files an appeal,\u00a0the Supreme Court is willing to consider the severity of the\u00a0prisoner&#8217;s mental illness. The court will\u00a0let a medical board evaluate\u00a0whether prisoners have\u00a0the mental capability to understand why they received a death penalty.<\/p>\n<\/div>\n<p><span style=\"background-color: #ffff00;\"><strong>3.
