Two days later, police said she married Ali Azhar, a\u00a043 or 44-year-old Muslim man.\u00a0Police also claimed she \u201cwillingly\u201d converted to Islam. According to police, Azhar shared a marriage certificate, which stated Raja was 18-years-old. Now, Raja&#8217;s parents are claiming she was abducted and forced to marry Azhar, who also happens to be their neighbor.\u00a0Raja&#8217;s parents tried to challenge the validity of the marriage by producing\u00a0her birth certificate, which reportedly shows she is only\u00a013.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Tell me more:<\/strong>\u00a0The Sindh Child Marriage Restraint Act states that\u00a0the minimum age of marriage is 18, and child marriage is a punishable offence. However, on October 27, the Sindh High Court (SHC) cited\u00a0<a href=\"https:\/\/www.catholicnewsagency.com\/news\/pakistan-catholics-protest-after-abduction-forced-marriage-of-13-year-old-arzoo-raja-67188\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-i\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNE92EoN6COvYJk0kiBR3W3dBSSIEg\">Sharia<\/a>\u00a0law and\u00a0<a href=\"https:\/\/www.persecution.org\/2020\/10\/29\/pakistani-court-validates-marriage-christian-teen-44-year-old-muslim-man\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-d\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNGpUrpOoJ1ZpfYgLKoFeo4S6wUoEw\">ruled in favor of the\u00a0marriage<\/a>\u00a0(i.e. under this interpretation of Sharia law, a child can apparently be married after her first menstrual period). According to the defence counsel of three suspects, who were detained for their\u00a0involvement in\u00a0the alleged abduction,\u00a0Raja said she converted and married Azhar\u00a0<a href=\"https:\/\/www.dawn.com\/news\/1587815\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-h\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNFVUtHrOYePuR-D5OP1SP3GtCWsMQ\">without any fear or pressure<\/a>. The defence counsel also claimed that Raja recorded\u00a0this\u00a0statement in the SHC. The three suspects are\u00a0police officers themselves &#8211; two of these guys are Azhar&#8217;s brothers. The three\u00a0detained suspects were granted bail later on. The SHC told\u00a0the police to not arrest Azhar.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>The context:\u00a0<\/strong>If you&#8217;re asking yourself &#8216;doesn&#8217;t Pakistan have a\u00a0minimum age requirement of 18 for marriage?&#8217; the answer is complicated. In 2014, the Sindh Assembly adopted the\u00a0<a href=\"https:\/\/www.loc.gov\/law\/foreign-news\/article\/pakistan-sindh-provincial-assembly-passes-child-marriage-restraint-bill\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-k\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNHWd-ow3ZMIC6gwtVwmc75hY-uPhg\">Sindh Child Marriage Restraint Act<\/a>\u00a0at a provincial level, which increased the minimum age of marriage to 18 years for girls and boys. The law proposed a fine and rigorous imprisonment of at least three years for men above 18\u00a0who\u00a0contract\u00a0a child marriage. This law\u00a0also punishes whoever is involved with performing or\u00a0facilitating\u00a0a child marriage, including guardians. However, the national-level\u00a0<a href=\"https:\/\/www.loc.gov\/law\/foreign-news\/article\/pakistan-child-marriage-bill-withdrawn\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-u\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNEc8hEHycWAkNg9kvGIg2KaZRLz2Q\">Child Marriage Restraint Act 1929<\/a>\u00a0makes the legal age of marriage 16 for girls, and 18 for boys.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><em><strong>Here\u00a0is a timeline of proposed amendments to the nationwide Child Marriage Restraint Act 1929:<\/strong><\/em><\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<ul>\n<li><em><strong>2014:\u00a0<\/strong><\/em>Pakistan Muslim League-Nawaz (PML-N) parliamentarian,\u00a0<a href=\"https:\/\/www.loc.gov\/law\/foreign-news\/article\/pakistan-child-marriage-bill-withdrawn\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-o\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNEtLSkCAem2xgYhVfU48OScQOj5IQ\">Marvi Memon<\/a>\u00a0sponsored a bill\u00a0to<em>\u00a0<\/em>revise the Child Marriage Restraint Act 1929. The proposed amendments\u00a0<a href=\"http:\/\/www.na.gov.pk\/uploads\/documents\/1397730973_450.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-b\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNElQYGgSytwZd7At5b7WfnHcBcqoA\">re-defined<\/a>\u00a0the meaning of a &#8216;child&#8217; as someone under 18, and made child marriage a recognizable offence with tougher punishments for whoever contracts or officiates\u00a0it.\u00a0However,\u00a0<a href=\"https:\/\/tribune.com.pk\/story\/1027742\/settled-matter-bill-aiming-to-ban-child-marriages-shot-down\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-n\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNHuL_qZN63AC55ZOYqqP6Etr5GFJw\">the Council of Islamic Ideology<\/a>\u00a0said &#8216;not a chance, laws related to the minimum age of marriage are against the Quran&#8217;s teachings.&#8217; The council ruled that children of any age could get married after hitting puberty.\u00a0Memon ended up withdrawing her bill in 2016 after the National Assembly (NA) Standing Committee on Religious Affairs rejected it.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div>\n<div>\n<ul>\n<li><em><strong>2017:\u00a0<\/strong><\/em>Pakistan People&#8217;s Party (PPP) Senator<em><strong>,\u00a0<\/strong><\/em><a href=\"https:\/\/www.dawn.com\/news\/1363275\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-p\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNHLDZAG4OKAlUEPp4SoWZ8nrU4bKw\">Sehar Kamran<\/a>\u00a0proposed an amendment to the Child Marriage Restraint Act 1929, which would raise the marriageable age to 18. However, the Senate\u00a0Standing Committee for Interior rejected Kamran&#8217;s revised bill, calling it\u00a0&#8220;un-Islamic.&#8221;<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div>\n<div>\n<ul>\n<li><em><strong>2018:\u00a0<\/strong><\/em>PPP\u00a0Senator\u00a0<a href=\"https:\/\/www.dawn.com\/news\/1460828\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/newsletter.thenewsrun.com\/t\/j-l-ajytdkd-iluykthdp-x\/&amp;source=gmail&amp;ust=1604430908176000&amp;usg=AFQjCNE4IJgnL8i78vWrE7PXL9VvJawQlQ\">Sherry Rahman<\/a>\u00a0introduced an\u00a0amendment to the Child Marriage Restraint Act 1929,\u00a0which proposed to raise the marriageable age to 18, and criminalize underage weddings.
